UCITA was produced by the National Conference of Commissioners on Uniform State Laws. NCCUSL, an organization of commissioners who are legislators, judges, law professors and lawyers appointed by every state, has produced all the uniform state commercial laws, including the Uniform Commercial Code (UCC).

UCITA was written by an NCCUSL drafting committee composed of commissioners from several states in an open, public drafting process, with full participation by interested parties, including consumer representatives. The committee met in a series of 16 public drafting meetings, which occured in major cities around the U.S. over a four-year period from 1996 - 1999. Interested participants from industry, trade organizations and consumer groups attended the drafting sessions, and expressed their views on all the issues. Additional interested parties submitted written comments.

All drafts of UCITA as well as the written comments were made available on the Internet (the drafting process was chronicled in The 2BGuide, the website which preceded UCITA Online).

The meetings were chaired by Carlyle (Connie) C. Ring, Jr., an NCCUSL commissioner who has considerable experience in chairing drafting committees, including several committees which revised articles of the UCC.

The actual writing was by Ray Nimmer (the Reporter), a professor at the University of Houston law school, author and scholar on information law, who produced the numerous drafts under the direction of the drafting committee.
